Welcome to FLEX SHOP. The terms “we,” “us,” and “our” refer to FLEX SHOP. FLEX SHOP operates this website and store, including all related information, content, features, tools, products, and services provided to you (the “Services”). Our store is powered by Shopify.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when using our Services.

By visiting, interacting with, or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, you should not access or use our Services.

We make every effort to display our products, colors, descriptions, sizing information, and images accurately. However, colors and product appearance may vary depending on your device, screen settings, lighting, and other factors.

Product descriptions, pricing, availability, and quantities may be changed without notice. We reserve the right to discontinue products or limit the quantity of products sold to any person, household, location, or jurisdiction.

SECTION 3 – AUTHENTICITY

FLEX SHOP is committed to offering authentic merchandise. Products may be sourced directly from brands, authorized retailers, distributors, and other trusted suppliers.

FLEX SHOP is an independent retailer and is not affiliated with, sponsored by, or endorsed by any brand unless explicitly stated.

SECTION 4 – ORDERS

Submitting an order constitutes an offer to purchase. We reserve the right to accept, decline, limit, or cancel an order at our discretion, including orders involving suspected fraud, incorrect pricing, inventory errors, payment issues, or unauthorized resale activity.

An order is not considered accepted until payment has been processed and we provide confirmation. If we change or cancel an order, we will attempt to contact you using the email address, telephone number, or billing information provided at checkout.

Please review your order carefully before submitting it. Once an order has been placed, we may be unable to change or cancel it.

All purchases are subject to our Return and Refund Policy.

SECTION 5 – PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when your order is submitted, unless a clear pricing or technical error occurred.

Unless otherwise stated, listed prices do not include applicable taxes, shipping charges, customs duties, import fees, or other charges.

You agree to provide accurate and complete billing and payment information. You represent that you are authorized to use the selected payment method and agree to pay all charges associated with your purchase.

Prices available online may differ from prices offered at our physical store or through third-party platforms.

SECTION 6 – SHIPPING AND DELIVERY

Delivery dates and transit times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, customs processing, incorrect addresses, or events outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. FLEX SHOP is not responsible for packages delivered to an address entered incorrectly by the customer.

Please inspect your order upon delivery. If your order arrives damaged, contains an incorrect item, or appears to be missing merchandise, contact us immediately at flexkickx@gmail.com with your order number and clear photographs.

Nothing in this section limits any rights available to you under applicable law.

SECTION 7 – FINAL SALES

All sales are final unless otherwise required by applicable law. We do not accept returns, exchanges, or cancellations for sizing issues, changes of mind, or unwanted items.

All website content, including our name, logo, text, graphics, photographs, videos, designs, and layout, is owned by FLEX SHOP or used with permission and is protected by applicable intellectual-property laws.

All third-party brand names, logos, product names, and trademarks belong to their respective owners.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

FLEX SHOP is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and FLEX SHOP.

Shopify is not responsible for merchandise sold by FLEX SHOP or for any injury, damage, loss, claim, or dispute arising from a purchase made through our store.

SECTION 11 – PRIVACY

Personal information collected through our Services is handled according to our Privacy Policy.

Because Shopify hosts our store, certain information may also be collected and processed by Shopify and relevant service providers to operate, protect, and improve the Services.

SECTION 12 – REVIEWS AND FEEDBACK

If you submit reviews, photographs, suggestions, ideas, or other content to us, you grant FLEX SHOP a worldwide, royalty-free, transferable, and sublicensable right to use, reproduce, modify, publish, distribute, and display that content for lawful business and promotional purposes.

You represent that you own or have permission to submit the content and that it does not violate another person’s intellectual-property, privacy, publicity, or other legal rights.

We may remove content that we determine is unlawful, misleading, abusive, offensive, fraudulent, or otherwise inappropriate.

SECTION 13 – ERRORS AND INACCURACIES

Our Services may occasionally contain typographical errors, incorrect prices, inaccurate descriptions, inventory mistakes, or omissions.

We reserve the right to correct errors, update information, or cancel orders affected by inaccurate information at any time, including after an order has been submitted. If we cancel a paid order, the amount charged for the canceled merchandise will be refunded.

SECTION 16 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, FLEX SHOP and its owners, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, or consequential damages arising from your use of the Services or products purchased through the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

SECTION 17 – INDEMNIFICATION

You agree to indemnify and hold harmless FLEX SHOP, Shopify, and our respective owners, employees, affiliates, agents, contractors, service providers, and licensors from third-party claims, losses, liabilities, and reasonable legal expenses arising from your violation of these Terms, applicable law, or another party’s rights.

SECTION 18 – TERMINATION

We may suspend or terminate your access to the Services if you violate these Terms or engage in activity that may harm FLEX SHOP, our customers, Shopify, or another party.

Any obligations and liabilities incurred before termination will survive termination.

SECTION 19 – SEVERABILITY

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law or removed to the minimum extent necessary. The remaining provisions will continue in effect.

SECTION 20 – WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

These Terms and the policies posted on our website constitute the entire agreement between you and FLEX SHOP concerning your use of the Services and replace previous agreements or communications relating to the Services.

SECTION 21 – ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our written permission.

We may assign or transfer our rights and obligations in connection with a business transfer, reorganization, merger, sale, or as otherwise permitted by law.

SECTION 22 – GOVERNING LAW

These Terms and any separate agreements through which we provide Services will be governed by the applicable laws of the Commonwealth of Massachusetts and the United States, without regard to conflict-of-law principles.

Any legal proceeding relating to these Terms will be brought in a court with proper jurisdiction over Lawrence, Massachusetts, unless applicable law requires otherwise.

We may update these Terms by posting a revised version on this page. Changes become effective on the date posted unless otherwise stated or required by law.

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
